Corbett To Offer Bill Related To Castro Valley Assisted-Living Care Case

LEGISLATURE | State Sen. Ellen Corbett says the chain of events leading to 14 elderly patients in Castro Valley being left unattended and alone at an assisted-care facility for two days is unacceptable. When the State Legislature reconvenes in the New Year, Corbett plans to introduce legislation to prevent another bizarre episode like the incident last month in Castro Valley, which may have involved an alleged unscrupulous assisted-living home operator.

“This situation in Castro Valley is a clear reminder that there is an urgent need for increased protections to prevent this tragedy from ever happening again,” said Corbett. “Residents at assisted living facilities are certainly vulnerable and both they and their families deserve the peace of mind of knowing that there are safeguards in place to protect residents if and when another facility closure occurs.”

A multiagency investigation is still combing through the details surrounding the incident at Valley Springs Manor. Last month, reports detailed over a dozen assisted-living patients were left without care for two days following allegations the staff had not been paid. The home was shut down by the State Department of Social Services. However, an untrained skeleton crew of a cook and a janitor stayed behind to help care for the patients. Nobody was harmed by the unsupervised days, but its potential alarmed many.

In a statement, Tuesday evening, Corbett said her bill may include ways for strengthening the state’s facility inspection and complaint process. It could also address how to better protect elderly patients once a facility is closed by a state agency. In the meantime, Corbett says she will meet with stakeholders in the assisted-living field, patients and state representatives to “determine the best legislative course of action to meet the specific and general needs to protect assisted living home residents.”

I get the feeling that whatever happens "in the news", that Corbett is going to create a bill.

There is something wrong about a never ending list of new bills to cure "every single" problem.
New regulations, more inspections,, and a new complaint process.
All costing more to a system wherein 90% of people can't afford to utilize the existing system.
(unless the state pays for 90% of the cost....meaning you and I pay for the new 'improved' system)

And you know, there will always be another problem, with a new bill to fix it...and on and on and on.

Corbett is a full believer in more government and more regulations. Pricing most of us out of the market for many services and goods.

At some point we can't afford Corbett. But new bills are her advertising system. Free.

Meanwhile we have a true unemployment rate of about $16% when you count unemployed, under employed, and labor market drop outs-- no longer counted.

But lets pile on new regulations while not responding to our real needs, like jobs.

California is not a job friendly state. Employers don't want to come here except for tech.

We don't need more laws and regulations so much as to: one, start enforcing the rules and regulations we already have; and two make it standard policy to fire any government "experts," "investigators," "inspectors," "monitors" and "regulators" who insist on performing at below the severely mentally retarded level.

For instance, we had the "experts" from the San Francisco Sheriff's Office, and who undoubtedly were making over 100K per year, who while looking for Lynne Spalding performed an "investigation" that was of far lower quality than if we had just grabbled a few ten year old children at random and paid them only five dollars each to search SF General Hospital and its stairwells.

And we had the highly paid "experts" who for twenty years missed locating Jaycee Dugard, since time after time after time they neglected to look in her kidnapper's backyard. Again, we could have fired all of those highly paid "experts" and instead sent a few ten year old children, and who we would have paid only minimum wage, to search for Jaycee Dugard, and they would have found a her a lot sooner than did those highly paid "expert investigators."

And then we had the professional pathological liars and/or extreme mental retards, er, excuse me, I mean highly skilled and highly paid "expert investigators," from the SF Police Dept and SF DA's office, who "proved" that the death of Hugues de la Plaza resulted from suicide rather than murder.

To sum up, our government and society is heavily infested and largely run, regulated, and "safeguarded" by a lot of highly paid "experts" who ought to be permanently placed in a home for the severely mentally retarded.

This type of legislation is definitely needed. I'm a senior that loves the fact that Ellen cares. I hope she will be elected to do this as our Congressional representative in 2014. We are not regulated enough as we saw with the bank fiasco. Ellen Corbett cares for Seniors as she has shown many times with her near perfect Senior voting record. Thanks Ellen for you compassion--a voter who has your back, as do most Seniors.

I live in Pleasanton, voted for Swalwell last time , but agree that Corbett is more principled and will probably vote for her if no one else jumps into the race. However in recent years it has become the trend to often send people to prison for engaging in asbestos violations and/or covering up asbestos violations, and rather than just fining them small amounts of money, SINCE THOSE WHO ENGAGE IN MAJOR ASBESTOS VIOLATIONS ARE ENGAGING IN SLOW MASS MURDER, and hopefully soon it will also become the trend to send to prison those who engage in coverups of major air pollution violations.

You know darn well that the Ombudsman function has always been under funded. You know darn well that the Adult Protective Services function has received insufficient funding for the last 15 years. And, you very well know that with the realignment of corrections, adult and child protective services from the state to the counties a move that essentially takes the responsibility away from the states and puts it on the individual counties is creating a huge risk to our elderly and children. So don't pretend you now care. Damn, I'm so angry with these elected officials.

And that is what happens when we have a depression and the State and Counties and Cities don't have enough revenue coming in. You have to cut your budget, and when you cut your budget you get less services and less oversight. You can thank the Tea Party Republican extremists for voting against tax increases and destroying regulations and regulation enforcement.

Ellen is constantly visiting Senior homes and Senior centers. Of course when legislators visit they put on a dog and pony show. It's lack of significant fines and regulations that allow the unscrupulous operators to stick it to the Seniors. We need more unannounced visits and heavy fines to prevent this abuse and a lot more inspectors. It's corporate money to business Democrats and Republicans that don't allow any significant bills to stop this. Maybe, just maybe this scandal will help this bill pass, but I doubt it. I'm a Senior and thank Ellen for trying to take on this vested interest, which most don't have the courage to do.

11:46 pm...it's not about visiting senior homes and senior centers. It's about making children and our seniors a priority. Fund them at a level that is reasonable. The Ombudsman function works but is seriously under funded. The program is primarily staffed with highly trained volunteers and is one of the most cost effective programs in the State. The Ombudsman are the eyes and ears at these nursing facilities and they are highly effective in identifying nursing home abuse and neglect. Why was this facility allowed to continue operating despite being on the state licensing radar? That's the main question.

As far as flip-flopping goes Swalwell has taken so many
different positions on so many topics he can't even remember

Tavares even did more than one article on his flip-flops. He

Eric is not running against Stark this time with his irascible temperament and personality. Ellen Corbett is a much more formidable foe and an extremely likable and capable politician.
