Swalwell Accepted Pay from Government Shutdown After Pledging Not to Take It

CONGRESS | 15TH DISTRICT | The great government shutdown of 2013 lasted 16 days. While the Tea Party wing of the Republican Party obstructed the budget process in a bid to scuttle Obamacare, federal employees went without a paycheck last October. Over half of the House of Representatives, including the East Bay's Rep. Eric Swalwell, pledged solidarity to government workers and said they would refuse their own paychecks until a new spending bill was approved.

However, KTVU reported Wednesday, Swalwell was actually paid roughly $4,700 earned during the shutdown, despite an attempt a day before the impasse to express sympathy for public workers. Conversely, South Bay Rep. Mike Honda did not make such a claim, reasoning he was still earning his pay while working for a resolution to the contentious budget fight.

In a letter sent last Sept. 30 to the Office of Chief Administrative Officer, Swalwell said, "I believe it is simply wrong and unfair for me to receive my salary while Americans working hard across the country as part of our federal workforce receive nothing until this appropriations crisis is resolved. Therefore, I ask that until federal employees who must work during a federal government shutdown are paid, I not be given my paycheck."

According to the report other local politicians claimed to have donated their salary to charity. However, Swalwell is not one of the wealthiest members of Congress and may not be able to afford such philanthropy. In fact, upon election to Congress in January 2013, Swalwell, 34, told the San Francisco Chronicle he would maintain a roommate in both the Washington, D.C. area and Dublin.

Was the letter and pledge to withhold his salary simply a publicity stunt? Likely, since according to the 27th Amendment, congressional pay cannot vary. Swalwell even acknowledges it in his letter, saying, "However, it is my understanding that I, as a Member of Congress, will continue to receive a paycheck." Meanwhile, it was incumbent on Swalwell to either give it back his pay to the U.S. Treasury or donate it to a charity of his choice. Instead, it went straight to personal bank account.

1) The letter Steven Tavares cited has a press release form Swalwell's Office saying; "Rep. Swalwell Refuses Paycheck During Shutdown until Working Federal Employees are Paid"

2) In the same press release there is Swalwell himself saying "in the event of a shutdown, I will refuse my paycheck until federal employees who must work during the shutdown are paid."

3) Citing a a letter Swalwell wrote to the congress: "In the event of a federal government shutdown, hundreds of thousands of federal employees will be furloughed. Others, who are deemed to perform essential services, will be forced to work. Despite the fact that these latter employers have to work, they will not receive paychecks during the period of a government shutdown. However, it is my understanding that I, as a Member of Congress, will continue to receive a paycheck.

You folks are thoughtless, full of propaganda and are a fan of FOX News it looks like. Congressman Swalwell has achieved a lot. He went from being a city level office holder to holding a national level office. He is not yet polluted by politics as Corbett is due to her long stint in Sacramento. Her Sacramento experience has taught her how she needs to safeguard her interest in keeping her seat instead of keeping the interests of the people at heart. After 12 years in Sacramento it is time she heeds to the call of term limits; term limits from politics where she becomes an ordinary citizen and watches the show from outside like we all do. I am very happy with our Congressman's performance and so are the majority. Right now, we need him because he has demonstrated that he can work with both the parties, a rarity in DC.

Time to turn attention to Tavares and his junk reporting. Instead of the junk he has reported, he could do all of us a favor by researching and reporting our Congressman's performance record. Find out if in the past two years if he has been just a bench warmer or how much of what he said he would do during his campaign is what he did.

So Tavares, clean up your reporting. Be objective and not report junk.

Everyone knows Swalwell staffers post on this blog. You can tell when they use the phrase "Cue the inevitable Swalwell staffer comments" Both 11:00 and the first 11:04 are the same staffer and have used those same lines on other posts.

These Corbett supporters who comment about how Swalwell cut unemployment benefits are plain wrong in two ways. First, he did not vote to cut benefits because the benefits were not in the budget due to the republicans not allowing it to be inserted into the budget.

Second, if you imply he should have voted against the budget to make a statement like BLee and therefore he is not progressive - and therefore vote for Corbett - you might want to check Corbett's record. Likewise due to Republican blocks - Corbett voted for state budgets that eliminated dental and eye care for the poor, cut more than $2 billion in medi-Cal health insurance for the poor, voted on numerous budgets that increased tuition for college students raising tuition over the past 6 years - five fold, voted on budgets that cut $3.5 Billion from CalWorks for the working poor to receive child care, ability to attend college for working poor, and she voted on budgets that have eliminated more than $145 million for health insurance for poor families.

So before you attack Swalwell - know your history or herstory - neither one of them wanted to see these cuts but the Republicans used their power to make them happen by shutting down government or holding the budget hostage at the federal and state level.

Point being - don't take a blog report or comment to heart without digging deeper.

Moreover, Ellen Corbett supported the lawsuit to receive backpay after the legislature failed to pass an on-time budget in 2011 and Controller John Chiang suspended legislators' salaries in accordance with Proposition 25.

Mrs. Miller and I will be supporting our outstanding CONGRESSMAN ERIC SWALWELL. We can't support novices who have no idea what they are doing and would be in above their head. We also would never support anyone who whores for the unions. The public knows that teachers and nurses' unions are nothing but whores for the special interests. They resonate with special interests only.

We'll be supporting a breath of fresh air, CONGRESSMAN ERIC SWALWELL 2014!

Plus many of us feel that we need more women in Congress because of the stubbornness of both sides. Women seem to be able to compromise more and work toward solutions instead of calling people names.
